These Terms and Conditions will apply to all goods purchased from Reebok Philippines (“We”, “Our” or “Us”) through our Online Store Service

This Website is owned and operated by the Sports Central Manila, Inc (“Reebok Philippines”).

Products, Pricing and Specifications

We do our best to provide you with an accurate description of the products featured in our catalogues, website and social media pages (collectively, the "Products"), but we cannot assure you that such description, color, information or other content available are accurate, complete, reliable, current or free from error. Some Product descriptions may include weight, measurements and other descriptions, but they are just approximate figures provided for your convenience only. We make all reasonable efforts to accurately display the attributes of the Products, including the available colors. However, the color you see in the catalogue, website and social media pages may differ from the actual color, depending on your mobile device, computer system, monitor, and/or other display features.

We may, at any time, change the price and other specifications of the Products.

Restrictions, Limitations or Conditions of Purchase

We may, without prior notice, limit the quantities sold through our Online Store service, to cancel any order at any time, and/or to refuse service to any customer. We will notify you through the email address or contact number you provided for any cancellation or change status in your order. We may also require verification of information prior to the acceptance and/or shipment of any order.

Payment

All prices indicated in our catalogue, website and social media pages are in Philippine Peso. The following payment options are available for your convenience:

1.) Pre-payment (Credit or Debit Card)

Most major credit and debit cards, such as Visa, Mastercard, JCB and American Express, are accepted. When you pay using your credit or debit card, you will be redirected to another website owned and operated by an independent payment gateway service provider, which shall collect and process your financial information pursuant to its own terms and own policies.

2.) Cash on Delivery (COD)

For COD transactions, cash payment will be collected by the courier contracted by us. The courier service will release the order to you upon acceptance of your payment. We may set certain limitations on the use of COD for any purpose.

Please note that all COD online store orders must be confirmed by the customer through email before it will be booked for delivery

If you fail to make any payment pursuant to the payment method selected or payment is cancelled for any reason whatsoever, we will cancel the order and suspend delivery of the Products until payment is made in full.

Shipping, Delivery and Store Pickup Limitations

After an order is placed and payment is made, you have the following delivery options:

1. Delivery
We have engaged independent service providers to deliver the Products to your designated address. To avoid delay or cancellation of delivery, you have to ensure that you are compliant with the independent service provider’s shipping restrictions and its terms and conditions.  If you will not be personally available to receive your delivery, please provide an authorization letter and a copy of your ID to an authorized representative for timely releasing of your order.

2. Store Pickup
Products purchased which are for store pick-up are subject to the store/branch’s pick-up guidelines and restrictions.

Delays may unfortunately occur due to high volume of orders, logistics limitations, geographic restrictions, inclement weather and other instances that are beyond our control. However, we will do our best to prepare your orders and have them ready for your pick up or deliver them the soonest we can.

Return and Exchange Policy

Return and exchange of Products are subject to our Return and Exchange Policy.

We would like to inform you that you may return and exchange items under the following conditions:

1. Return and exchange is within a period of 30 days from date or receipt of item
2. Accompanied by the original receipt, and
3. Item is unused, in its original packaging with swing tags and box intact.
4. Original Shipping cost and return shipping fee cost will not be repaid.

In addition, we would like to advise you that the following conditions are not entitled to a refund or exchange under Consumer Act of the Philippines (RA 7394)

1. Defective items unless defect is caused by misuse or mishandling of items by customer
2. Change of mind of customer
3. For sanitary and hygienic reasons, socks, stockings, bras and similar items will not be accepted for return or exchange

Generally, merchandise returns and replacement is subject to company policy and procedures and it should be coordinated with our authorized representative in our Facebook page or with our Store Manager in the Sports Central store where item is purchased.

All return/exchange of items will be done through the Sports Central store where  the item is purchased.  If the replacement item is lower in price, no refund will be given. Customer will settle any excess amount if the price of the replacement item is higher. 

Refund Policy

In the event that we cancel your order for reason beyond our control, we will refund the amount you paid for the item, net of discounts. For credit card charge back, it may take longer as it will be highly dependent on your credit card issuing bank. We recommend checking your next billing statement for validation.

Accuracy of Information

Our catalog, website and social media pages may contain typographical errors or inaccuracies and may not be complete or current. As such, we may correct any errors, inaccuracies or omissions (including after an order has been submitted) and change or update information at any time without prior notice. Such errors, inaccuracies or omissions may relate to pricing and availability, and we may cancel or refuse to accept any order placed based on incorrect pricing or availability of information.

Limitations on Liability

This limitation of liability (“Limitation”) applies only to your free use of the Site. This Limitation does not apply to, for example, your purchase of any product or service from Reebok Philippines. This Limitation also does not apply to, for example, our offer or advertisement of any Reebok Philippines product or service including the content of any offer or advertisement on the Site.

Your use of the Site is at your own risk. You agree that our sole obligation to you is to provide the Site “as is.” Neither Reebok Philippines nor any of its employees, officers, directors nor any of its agents or any other party involved in creating, producing or delivering the Site shall be liable to you or to any third party for your use of, or the inability to use, the Site and its Content except in cases of (a) gross negligence, recklessness, or an act of knowing or intentional willful misconduct; or (b) a violation of a consumer protection statute in connection with the Site.

We, our parents, subsidiaries, affiliates or partners, or our/their respective directors, officers, shareholders, employees and agents will not be responsible or liable for any ordinary, direct, consequential, incidental, special, punitive or exemplary damages or another losses or liabilities arising out of: (a) use of the Product; (b) delay in delivery of the Product; and (c) breach by independent service providers.

For the Product purchased, your sole remedy, if any, is with the manufacturer or supplier of the Product, in accordance with such manufacturer's or supplier's warranty, or to seek a return or refund for such Products in accordance with our Return and Exchange Policy as stated above.

Links to Third Parties

For your convenience and to improve the usage of the Site, links to websites that are owned and controlled by third parties may be provided from time to time. These links take you outside Reebok’s service and off the Site and are beyond Reebok’s control. This includes links to partners that may use the Trade Marks as part of a co-branding agreement. The sites you can link to have their own separate terms and conditions as well as a privacy policy. Reebok is not responsible and cannot be held liable for the content and activities of these sites. You therefore visit/access these sites entirely at your own risk.

Please note that these other sites may send their own cookies to users, collect data or solicit personal information, and you are therefore advised to check the terms of use and/or privacy policies on those websites prior to using them.

Misuse of the Site

You are prohibited from using the Site to post or transmit any User Generated Content (as defined below) which infringes or may infringe third party intellectual property rights or which is threatening, false, misleading, inflammatory, defamatory, invasive of privacy, obscene, pornographic, abusive, discriminating, illegal or which could constitute or encourage conduct that would be considered a criminal offence, violate the rights of any party or which may otherwise give rise to civil liability or violate any law. Reebok may deny you access to the Site at any time in its sole discretion and which shall include situations where Reebok believes that your use of the Site is in breach of any of these Terms and Conditions and/or applicable laws. You are further prohibited from using the Site to impersonate another person, user or Reebok staff, employee, or representative, imply that any statements you make are endorsed by Reebok, or post or transmit any material that could damage or disparage Reebok or any of its affiliate entities in any manner.

You are also prohibited from using the Site to advertise or perform any commercial solicitation.

You may not, while accessing or using the Site: request, or otherwise attempt to harvest, obtain or store, personal information, passwords, account information or any other type of information relating to other users; access or use another person's account; disguise the origin of any communications; alter, modify, frame, or "mirror" any Content; create a deep-link to our Site by by-passing our Site's homepage; use any data mining, robots, or similar data-gathering and extraction tools in connection with the Site; inhibit, disrupt, or otherwise prevent anyone from using or accessing the Site or interrupt any user's experience on the Site, including, but not limited to, acting in any manner that disrupts users' real-time exchanges; interfere with or disrupt the Site, or servers or network connections to the Site, disobey any requirements, procedures, policies or regulations of networks connected to the Site; modify, adapt, sublicense, translate, sell, reverse engineer, decompile or disassemble any portion of the Site; or attempt to gain unauthorized access to the Site (or any portion thereof).

User Generated Content

All opinions, remarks, comments, artwork, graphics, photographs, links, questions, suggestions, information, videos and other materials that you or other users of the Site post to the Site or transmit using the Site (“User Generated Content”) will be deemed non-confidential and non-proprietary. Accordingly, Reebok Philippines, and its parent and affiliate entities and those acting at their direction, shall have the non-exclusive, perpetual, royalty-free, right to use, copy, distribute and disclose to third parties any User Generated Content for any purpose, in any medium and throughout the world (license grant). You acknowledge and agree that Reebok only acts as a passive conduit for the distribution of the User Generated Content and is not responsible or liable to you or to any third party for the content or accuracy of the User Generated Content. Reebok Philippines does not continuously monitor User Generated Content published by you or moderating between users, nor shall Reebok Philippines be under an obligation to do so. Without limit to the generality of the foregoing, you acknowledge and agree that any remarks, opinions, comments, suggestions and other information expressed or included in the User Generated Content do not necessarily represent those of Reebok. Any use by you of the User Generated Content is entirely at your own risk. You represent that any User Generated Content posted or transmitted by you is original to you and does not copy the work of any third party or otherwise infringe any third party intellectual property rights, rights of privacy or moral rights and does not contain any defamatory or disparaging statements. Furthermore, you represent that you have the capacity to grant the license as stipulated in this paragraph. You understand that you and any other persons that are included in any of your Content may be requested by Reebok to sign documents acknowledging agreement to these Terms and Conditions. You acknowledge and agree that Reebok Philippines  is not responsible for any content, including, user generated content, that purports to give advice, including medical advice, regarding diet, training, fitness or exercise or the use of any products or services.

Reebok Philippines reserves the right at its sole discretion, but has no obligation, to block or remove (in whole or part) any User Generated Content posted or transmitted by you and which Reebok Philippines believes is not in accordance with these Terms and Conditions (including materials which infringe or may infringe third party intellectual property rights, rights of privacy or moral rights), or is otherwise unacceptable to Reebok Philippines. Reebok Philippines reserves the right, but has no obligation, to suspend or terminate user accounts or user IDs and to take technical and legal steps to prohibit access to the Site if we think that those users are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of these Terms and Conditions or our policies. Reebok Philippines reserves the right to cancel unconfirmed user accounts.

You agree to promptly notify Reebok in writing (see “How you can contact us” below for contact details) of any User Generated Content (or other Content) which breaches these Terms and Conditions. You agree to provide to Reebok Philippines sufficient information to enable Reebok to investigate whether such User Generated Content (or other Content) breaches these Terms and Conditions. Reebok Philippines agrees to make good faith efforts to investigate such complaint and shall take such action as Reebok Philippines in its sole discretion decides. However, Reebok Philippines does not warrant or represent that it will block or remove (in whole or part) such User Generated Content or other Content.

Submissions

Reebok Philippines maintains a policy of not reviewing or accepting any unsolicited submissions of ideas, inventions, designs and/or other materials related to Reebok Philippines business (including without limit footwear, apparel, sporting goods and services) whether consisting of texts, images, sounds, software, information or otherwise (the “Materials”) from persons external to Reebok. You should therefore not post any Materials on the Site or send these to Reebok Philippines by e-mail or otherwise. Other than personally identifiable information, which is subject to the Privacy Policy, any Materials you transmit or post to the Site in any form or manner (i) are and will be considered non-confidential, non-personal, and non-proprietary to you or anyone else and (ii) may be disseminated or used by Reebok Philippines or its affiliates for any commercial or non-commercial purposes in any media, now known or hereafter created, as Reebok may determine, in its sole discretion, including, but not limited to, in the development, manufacturer or marketing of products for commercial use, without (a) compensation to you or anyone else or (b) acknowledgement of you or anyone else as the source of the submission. Therefore, do not transmit or post to the Site any Materials you would like to keep confidential or for which you would like or expect acknowledgement or compensation.

Customer Data & Your Right to Privacy

Your consent to the collection, use and processing of your personal data was obtained at the time of submission of your orders. As previously disclosed, your personal data will be used for any or all of the following purposes:

1. To process, verify, complete and to deliver your purchase/s
2. To perform such service/s which you may require from us;
3. To conduct research, analysis and activities such as, but not limited to, data analytics, surveys, product and service development, so we can improve our services or products;
4. To update and inform you from time to time regarding promotions and our new products or services which you may want to avail of.

There may be instances when we will share your data to third parties in order to fulfill or complete your transactions with us. These third parties may include our accredited logistics providers, payment gateways, your issuing banks or the financial institutional partners which you chose to facilitate payment for your purchases. Payment gateways maintain their own platforms where you will be requested to provide your personal and financial data in order to process your payment. Although the control of the platform remains with the payment gateway provider, we have requested them to ensure that they have adopt industry standard protocols to keep your data secured.

Access to your personal data by our authorized personnel is only for the purposes of carrying out the above mentioned legitimate business purposes.
